THIS TERMS OF SERVICE AGREEMENT (the “Agreement”) constitutes a legally binding agreement by and between Fuel Software d.o.o., a company organized under the laws of Croatia (“LeadWizzy”), and the client, whether personally or on behalf of an entity (“Client”), with regard to access and use of LeadWizzy’s services and website: https://www.leadwizzy.com (the “Website”) and any other media form, channel, mobile website, or mobile application related, linked, or otherwise connected thereto. Failure to agree and adhere to all of the terms, conditions, and obligations contained herein results in the express prohibition of the Client’s use of the Website and services, and the Client is ordered to discontinue use immediately. Thereafter, the relationship between Client and LeadWizzy shall cease and be of no further force and effect between the parties, except that any obligation of Client to pay LeadWizzy for services rendered shall remain and continue to be an ongoing obligation owed by Client to LeadWizzy.
LeadWizzy provides digital marketing services available through monthly subscriptions/memberships. The specifics of the services offered are detailed on our website, the subscription payment page, and the confirmation email sent to you upon purchase.
Subscription Fees: By subscribing to LeadWizzy, you agree to pay the fixed monthly fee associated with the chosen subscription plan.
Payment Processing: All payments are processed through our third party independent payment provider Stripe. You must provide accurate billing information and update it as necessary to maintain your subscription.
No Refunds: All payments made to LeadWizzy are non-refundable. By subscribing, you acknowledge and agree to this no-refund policy.
Official Communication: LeadWizzy communicates with clients via email. The official email address for all correspondence is [email protected].
Responsiveness: Clients are expected to monitor their email for important updates and communications from LeadWizzy.
Cancellation Policy: Clients may cancel their subscription at any time. To cancel, please contact us at [email protected]. Cancellations will take effect at the end of the current billing cycle.
No Guarantee of Success: LeadWizzy does not guarantee any specific results or success from the use of its services. While we strive to provide the best possible outcomes, results may vary depending on various factors beyond our control.
Indemnification: By using our services, you agree to indemnify and hold LeadWizzy harmless from any claims, damages, losses, liabilities, and expenses arising out of your use of our services.
Limitation: LeadWizzy shall not be liable for any damages caused to the Client's business as a result of our work, as all work is carried out with the Client's compliance and approval. The Client assumes full responsibility for the outcomes of the services provided by LeadWizzy.
Client Ownership: All tools used in the work, such as advertising software like Facebook Ad Manager, Google Ads, and similar platforms, are owned by the Client. The Client is responsible for maintaining access to these tools and paying any associated fees.
Support and Responsibility: LeadWizzy will instruct and assist the Client in setting up any required tools. However, LeadWizzy is not responsible for the functionality of these tools, any changes in their pricing, or if they become paid services. These responsibilities lie solely with the Client.
There are no definite due dates for the delivery of work. However, LeadWizzy provides estimated delivery times upon Client's request so that the Client will know when to expect the work to be completed. Please note that there is always a margin of error applied to these estimates.
Changes to Terms: LeadWizzy reserves the right to modify these terms of service at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our services after such modifications will constitute your acceptance of the revised terms.
Jurisdiction: These terms of service are governed by and construed in accordance with the laws of Croatia. Any disputes arising out of or related to these terms or our services will be subject to the exclusive jurisdiction of the courts in Croatia.
Operating Entity: LeadWizzy is a brand that operates under Fuel Software d.o.o. All references to LeadWizzy in these terms of service are understood to include Fuel Software d.o.o. as the operating entity.
Ownership: LeadWizzy maintains all rights to its intellectual property, including but not limited to, software, algorithms, methodologies, processes, and any other proprietary information.
Client Materials: All materials and resources provided to the client by LeadWizzy, including but not limited to reports, data, and creative works, become the property of the client upon delivery. The client owns these materials 100%.
Licensed Materials: If any materials provided to the client include licensed components, such as fonts or stock images, LeadWizzy will notify the client of the need to purchase the appropriate licenses. The client is responsible for obtaining and paying for these licenses to use the materials legally.
